Terms of Service

These Terms of Service govern your access to and use of LiveJudge. Please read them carefully — by creating an account or using the Service, you agree to these Terms.

1. Agreement to these Terms

These Terms of Service ("Terms") are a binding agreement between you and Kranitz Enterprises Inc ("LiveJudge," "we," "us," or "our"). They apply to the LiveJudge website and the LiveJudge judging and scoring platform (together, the "Service"). If you use the Service on behalf of an organization, you represent that you are authorized to accept these Terms on that organization’s behalf, and "you" includes that organization.

If you do not agree to these Terms, do not use the Service.

2. Who can use the Service

You must be able to form a binding contract to use the Service. If you are under the age of 18, you may use the Service only with the involvement and consent of a parent, guardian, or the event organizer responsible for you. Event organizers are responsible for ensuring they have any consents required to include minors as contestants or participants in their events.

3. Accounts

You are responsible for the information you provide, for keeping your login credentials secure, and for all activity that occurs under your account. Notify us promptly at help@livejudge.com if you believe your account has been used without your authorization. We are not liable for losses caused by unauthorized use of your account.

4. Roles: organizers, judges, and participants

The Service supports different roles. Event organizers create and configure events, invite judges, and manage scoring. Judges enter scores and evaluations. Contestants, participants, and spectators take part in or view events as configured by the organizer.

Event organizers are responsible for how their events are run, including the criteria, scoring rules, and results, and for their communications with and treatment of judges and participants. LiveJudge provides the tools; the organizer controls the event.

5. Acceptable use

You agree not to misuse the Service. In particular, you will not:

  • use the Service for any unlawful purpose or in violation of these Terms;
  • attempt to gain unauthorized access to the Service, other accounts, or our systems;
  • interfere with or disrupt the integrity or performance of the Service;
  • upload content that is illegal, infringing, harmful, or that you do not have the right to share;
  • reverse engineer, copy, or resell the Service except as permitted by law; or
  • use the Service to manipulate or misrepresent the results of a competition in a way that deceives participants.

6. Your content

You and your event participants may submit content to the Service — for example event details, judging criteria, scores, rankings, and related materials ("Your Content"). You retain ownership of Your Content. You grant us a limited license to host, process, and display Your Content solely to operate and provide the Service to you and your event’s participants.

You are responsible for Your Content and for having the rights necessary to submit it. We may remove content that violates these Terms or the law.

7. Our intellectual property

The Service, including its software, design, and the LiveJudge name and logo, is owned by Kranitz Enterprises Inc and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms. We reserve all rights not expressly granted.

8. Fees

Some features of the Service may require payment. Where fees apply, they will be described at the time of purchase or in a separate order or plan. Unless stated otherwise, fees are non-refundable except as required by law. We may change our fees on a going-forward basis with reasonable notice.

9. Third-party services

The Service may link to or integrate with third-party services that we do not control. Your use of those services is governed by their terms, and we are not responsible for them.

10. Availability and changes

We work to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features of the Service at any time. We will use reasonable efforts to give notice of material changes that adversely affect your use.

11. Disclaimers

The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will meet your requirements or that scoring results will be free from error where errors arise from inputs, configuration, or third-party conditions outside our control.

12. Limitation of liability

To the fullest extent permitted by law, Kranitz Enterprises Inc will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us for the Service in the twelve months before the claim, or US $100.

13. Indemnification

You agree to indemnify and hold harmless Kranitz Enterprises Inc from claims, damages, and expenses (including reasonable legal fees) arising out of your use of the Service, Your Content, your events, or your violation of these Terms or the rights of others.

14. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the Service or its users. Provisions that by their nature should survive termination — including ownership, disclaimers, limitation of liability, and indemnification — will survive.

15. Governing law

These Terms are governed by the laws of the State of Colorado, United States, without regard to its conflict-of-laws rules. The state and federal courts located in Denver, Colorado will have exclusive jurisdiction over any dispute that is not otherwise resolved, and you consent to their jurisdiction and venue.

16. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the effective date above and post the updated Terms here. Your continued use of the Service after changes take effect means you accept the updated Terms.
